Nido — Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Juan Diego Cruz Ruiz ("Nido," "we," "us," or "our") governing your use of the Nido mobile application and related services (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
2. Your account
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly at [email protected] if you suspect unauthorized use of your account. You are responsible for the accuracy of the financial and other information you enter into the Service.
3. Households and shared use
Nido is designed to be used by couples and households: - When you create or join a household, information you choose to share becomes visible to the other member(s) according to your visibility settings, as described in our Privacy Policy. - Each member is responsible for their own conduct within the household. You should only invite people who consent to join and to share information with you. - Disputes between household members are your responsibility, not ours. Nido is a tool for shared visibility and coordination; we are not a party to, and are not responsible for resolving, financial or personal disputes between household members. - Certain jointly created information may remain associated with a household even after a member leaves, as described in our Privacy Policy.
4. License to use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, or create derivative works from the Service except as permitted by law.
5. Subscriptions, billing, and payments
Free and paid plans. The Service offers a free tier and one or more paid ("Premium") plans. Paid plans are billed per household and unlock additional features as described in the app.
Auto-renewal. Paid subscriptions automatically renew at the end of each billing period unless canceled beforehand. Your payment method will be charged the applicable price for each renewal period until you cancel.
Cancellation. You can cancel at any time. For subscriptions purchased through the Apple App Store or Google Play, manage and cancel through your app-store account settings; cancellation takes effect at the end of the current billing period. For subscriptions purchased through other payment methods (for example, in Colombia via Wompi, which supports Nequi and PSE), follow the cancellation instructions provided at purchase or in the app.
Prices and changes. Prices vary by country and payment method, and may change over time. As of the Effective Date, the Premium plan is offered in the United States at USD $7.99 per month or USD $79.99 per year. Other countries, including Colombia, may be offered different, locally adjusted pricing at checkout — this reflects local purchasing power and is not a discount error. We will give notice of material price changes as required by law, and changes apply to future billing periods, not to a period you've already paid for.
Refunds. Except where required by applicable law, payments are non-refundable. Refunds for purchases made through the app stores are subject to the applicable store's policies.
Free trials. If we offer a free trial, the terms (including duration and the price and timing of the first charge) will be disclosed clearly before you start. Unless you cancel before the trial ends, you will be charged the disclosed price when it ends.
6. Important financial disclaimers
Please read this section carefully: - Nido is not a bank and does not hold funds, take deposits, issue accounts, or move money on your behalf. - Nido does not provide financial, investment, tax, accounting, or legal advice. The Service is an informational and organizational tool only. Any information it displays is for your general awareness and is not a recommendation. - You are responsible for your own financial decisions and for the accuracy of the information you enter. - We do not guarantee the accuracy, completeness, or timeliness of any information in the Service, including balances, categorizations, or data retrieved from third-party financial providers. Always verify important information with your financial institution. - You should consult a qualified professional before making financial decisions.
7. Bank connections and third-party financial data
If you choose to connect an external financial account, that connection is provided through third-party providers (such as Plaid or Belvo). Your use of those providers is subject to their terms and privacy policies. You authorize us and those providers to access and process information from your connected institution to provide the Service. You are responsible for ensuring you have the right to connect any account you link. We are not responsible for the acts, omissions, availability, or accuracy of third-party providers or financial institutions.
8. Your content
You retain ownership of the content you create in the Service (such as entries, notes, and comments). You grant us a limited license to host, store, process, sync, and display that content solely to operate and provide the Service to you and your household. You are responsible for your content and for ensuring you have the rights to share it.
9. Acceptable use
You agree not to: - use the Service for any unlawful, fraudulent, or harmful purpose; - access another person's account or data without authorization; - upload malicious code or attempt to disrupt, overload, or compromise the Service; - attempt to gain unauthorized access to our systems or other users' data; - reverse-engineer, scrape, or misuse the Service or its data; or - use the Service to harass, abuse, or harm another person.
We may suspend or terminate access for violations.
10. Intellectual property
The Service, including its software, design, branding, "Nido" name and logo, and content we provide, is owned by Juan Diego Cruz Ruiz or its licensors and is protected by intellectual-property laws. Except for the license granted to you, we reserve all rights.
11. Third-party services
The Service integrates with or links to third-party services (for example, app stores, payment providers, analytics, and financial-connectivity providers). We are not responsible for third-party services, and your use of them is governed by their own terms.
12. Disclaimers of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will be accurate or preserved. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Juan Diego Cruz Ruiz and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of USD $50 (or the equivalent amount in local currency) or the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Juan Diego Cruz Ruiz and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of the rights of another person.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and dispute-resolution provisions) will survive.
16. Changes to the Service and these Terms
We may modify or discontinue features of the Service, and we may update these Terms from time to time. If we make material changes to these Terms, we will provide notice through the Service or by other reasonable means. Your continued use after the changes take effect constitutes acceptance.
17. Governing law and dispute resolution
These Terms are governed by the laws of Colombia, without regard to conflict-of-laws rules. Any dispute arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of Cali, Colombia. However, if you are a consumer residing in another jurisdiction, you may be able to bring claims in the courts of your country of residence if required by applicable mandatory consumer-protection laws. Nothing in these Terms limits any rights you have under mandatory consumer-protection laws of your country of residence.
18. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Apple/Google terms. If you download the app from the Apple App Store or Google Play, you also agree to that store's applicable terms, and the standard end-user license terms of that store apply in addition to these Terms.
